Flexibility in zoning sought by Copher

Allowing for flexibility in design, according to Gary Carnahan, the engineer, Josh Copher, developer of Summit Meadows, requested R-2 zones for three phases of the subdivision.
Rezoning ordinances for three phases of Summit Meadows subdivision are to be presented to the Pea Ridge City Council at the regular meeting Tuesday, April 20.
The rezonings were approved conditionally by the Planning Commission at the April meeting contingent on an attachment of restrictive covenants limiting the maximum number of units per acre to six. Those covenants had not been approved by the April meeting, but were reviewed at the May 6 Planning Commission meeting.
At that meeting, discussion arose following the presentation of two different forms of the ordinance, one calling for an "average"of six units per acre, the other for six units per acre.
Planner M. J. Hensley said he seconded the motion at the regular meeting for a maximum of six units per acre and would make a motion to approve the covenants if it followed the original motion.
"This one on the desk is different than the one I received by e-mail," said Al Fowler, planner.
Carnahan and Copher questioned the wording and Copher questioned the definition of "acre."
Mayor Jackie Crabtree called for reading the wording of the original motion by Dr. Karen Sherman, planner, at the April meeting.
"You have to say what you're going to do and do what you say," Hensley said.
"I'm not for allowing averaging," Fowler said.
Ultimately, the covenant was approved with six units per acre subject to proof that all neighbors had been notified.
Tracy Messer is expected to give a report from the Pea Ridge Parks Commission.
