Woman sues landlord over accidental shooting

A Fayetteville woman has sued a man who allegedly shot her in the neck area last June at an apartment she rented from him after he tripped and fell with the gun.

Paula R. Hinton filed the lawsuit late Wednesday afternoon in Washington County Circuit Court via her attorney, Jason Watson. The defendant in the case is James Earl Yates, also of Fayetteville.

On June 19, 2005, according to the suit, Hinton was shot in the neck area by Yates. He owned the apartment that was being rented by Hinton and her roommate, Wendy Henderson, according to the suit.

Yates, at Henderson’s request after her argument with Hinton, entered the apartment with a. 22 caliber Derringer before he “ carelessly and negligently” tripped and fell, causing the gun to fire and hit Hinton in the neck area, the suit alleges.

The suit states that the shooting was caused by Yates’ negligence and, as a result, Hinton suffered “ severe injuries of a temporary and permanent nature, ” and she is entitled to judgment against him for past and future medical bills; pain, suffering and mental anguish; loss of earnings; and loss of “ enjoyment of life. ”
