$2 million awarded for water damage

BENTONVILLE — Neither the defendant nor his attorney appeared in court Monday morning, but a jury awarded the plaintiff in a lawsuit more than $ 2 million.
A jury trial was scheduled Monday for Jerry Cook’s lawsuit against Lochmoor Club LLC. The suit claimed that increase water flow from the subdivision on Arkansas Highway 112 damaged Cook’s land.
The case is assigned to Circuit Judge John Scott.
Neither representatives for Lochmoor nor its attorney, Michael Garzoni, appeared Monday morning for the court proceedings. They also failed to appear Friday for a pretrial conference.
Scott fined Garzoni $ 5, 000 and instructed that an order be issued for Garzoni’s appearance.
The judge allowed the proceedings to continue, and the jury heard testimony concerning the damage to Cook’s property.
The jury returned with a verdict awarding Cook $ 2. 2 million.
